Terms and conditions of cancellation for personal items of photography

As a matter of principle, consumers have the right to cancel an order or return the goods ordered when a distance contract has been concluded. Please take the time to read the following cancellation policy. However, this right to cancel shall not apply in the event of distance contracts involving the delivery of goods which have been produced to your specifications, or which have been custom-made according to your specific personal requirements or which by nature are not suitable to be returned.

With regard to the photographs offered and the goods printed with photographs, we assume that these have been produced to your specifications with your personal photographs and as such, have been custom-made according to your specific personal requirements. Therefore, the order placed is binding and you shall not have the right to cancel or return it. Naturally, this does not affect the warranty offered to cover defects in quality.

Consumer cancellation policy

1. The right to cancel for distance sales involving non-personalised goods

You shall have the right to cancel this contract within fourteen days without stating your reasons.
The fourteen-day cancellation period runs from the date on which you, or a third party who is not the carrier and who has been named by yourself, received the goods.
In order to exercise your right to cancel, please inform us (Top-Fotografie GmbH, Kurze Straße 16, 09577 Niederwiesa, Tel.: (0) 3726 / 32 78, E-Mail: ... ) about your decision to cancel this contract by sending us a clear declaration (e.g. fax, email or a letter sent via post). To this end, you may use the cancellation form template provided, but this is not mandatory.
In order to adhere to the cancellation period, it is sufficient to send off the notification regarding your choice to exercise your right to cancel before the cancellation period ends.

2. What happens if you cancel

If you cancel this contract, we must refund any payments we have received from you, including delivery costs, immediately or within fourteen days from the date on which we received the notification of your decision to cancel the contract at the latest. To effect the refund, we shall use the same payment method you used to complete the original transaction, unless expressly agreed otherwise with yourself. Under no circumstances will you be charged as a result of this refund. We may withhold the refund until the goods have been returned to us or until you provide evidence that you have sent the goods back, whichever comes first.
You must send or give the goods back to us immediately, or in any case, within fourteen days from the date on which you informed us about your decision to cancel the contract at the latest. This deadline shall be considered observed if you send the goods off before the end of the fourteen days. You shall bear any costs incurred as a direct result of returning the goods. You must only compensate for any loss in value of the goods if you have handled these goods in an unnecessary manner so as to test their nature, properties and functionality and, as a result, caused this loss in value.
